01General
Welcome to https://aanjapan.co.jp A.A.N. Japan Co., Ltd (“AAN Japan”) provides website features, account access, products and services (collectively “AAN Japan Services”) to you when you visit or shop at https://aanjapan.co.jp These Terms of Use (“Agreement”) governs your access to and use of the AAN Japan Services. In compliance with the Japanese Act on Specified Commercial Transactions, AAN Japan provides a separate Legal Notice available here. By clicking the check box presented with these Terms and creating an account with AAN Japan, or by accessing or using any of the AAN Japan Services, you agree to be bound by this Agreement. You represent and warrant that you are legally able to enter into binding contracts. If you are entering into this Agreement on behalf of an entity, you represent and warrant that you have the legal authority to bind that entity. AAN Japan reserves the right to update or modify these Terms at any time, without prior notice. Your continued use of the AAN Japan Services after any changes constitutes your acceptance of the revised Terms.
02User registration
Submitting an application for registration does not guarantee the creation or approval of your account. All applications are subject to review and approval at sole discretion of AAN Japan. AAN Japan reserves the right to refuse any application under following conditions, and is under no obligation to disclose reasons for refusing applications: • The information provided in the application is determined to be inaccurate, incomplete, or falsified; • The application is from a user, who previously violated these Terms or any other AAN Japan policies; • The applicant is deemed not to be in compliance with AAN Japan’s compliance policies; • The applicant fails to pass AAN Japan’s KYC (Know Your Customer) verification; • Any other reasonable circumstances under which AAN Japan determines that the registration is not appropriate.
03User ID and Password
You are solely responsible for maintaining the confidentiality and security of your user ID and password. You must not allow any third party to use, transfer, lend, rename, or sell your user ID or password. You may register additional access for persons affiliated with you or your company through your account page, provided such access is in compliance with this Agreement. You agree to be fully responsible for all activities conducted under your account, user ID, or password. In all cases, you will be solely responsible for any losses or damages arising from: 1. Insufficient management or protection of your user ID or password; 2. Unauthorized use by a third party; 3. Any other similar circumstances. AAN Japan shall not be liable for any such losses or damages.
04Dormant Accounts
If more than four (4) years have passed since your last transaction, AAN Japan may deactivate your customer account and place any remaining funds in a dormant status. Such funds will not be forfeited, but will be withheld from active use. Upon your written request, AAN Japan will restore access to the withheld funds in accordance with applicable laws and regulations.
05Prohibitions
When using AAN Japan Services, you agree not to engage in any of the following: • Use the AAN Japan Services to violate any applicable law, regulation, or the rights of others; • Attempting to gain unauthorized access to the AAN Japan Services, other accounts, computer systems, or networks connected to the Services; • Circumventing or attempting to circumvent security or authentication measures; • Uploading, posting, or transmitting viruses, malware, spyware, or any other malicious code; • Engage in phishing, fraud, or other deceptive or misleading activities; • Copying, modifying, reverse engineering, decompiling, or otherwise attempting to derive source code or underlying ideas from the AAN Japan Services; • Interfering with or disrupting the integrity, performance, or availability of the AAN Japan Services; • Use the AAN Japan Services to collect or transmit sensitive personal data in ways that violate privacy or data protection laws; • Create, share, or distribute content that is illegal, harmful, obscene, harassing, or discriminatory; • Exploiting the AAN Japan Services for purposes unrelated to AAN Japan’s intended business operations; • Use the AAN Japan Services for any activity that conflicts with AAN Japan’s compliance and KYC policies.
06Restrictions on Auction Information Sharing
You agree not to, and you will not permit any third party to, directly or indirectly: • Post, upload, distribute, display, or otherwise make available to the public any auction-related information obtained through Authorized Auction Platforms for Customer Use, including but not limited to CIS NINJA, and similar systems; • Repost or disseminate auction information via video-sharing platforms (e.g., YouTube, TikTok) or social networking sites (e.g., Instagram, Facebook, X, Telegram, Line, etc.); • Publish or display auction data on company websites, car introduction or sales sites, or in any other public or private online or offline medium. The foregoing restrictions apply regardless of whether the vehicle in question was purchased by you. Violation of this Section may result in immediate suspension or termination of your account.
07Intellectual Property Rights
All content, materials, and features made available through the AAN Japan Services (collectively, the “Content”), are the property of AAN Japan, its licensors, or other content providers. Except as expressly authorized, you may not copy, reproduce, modify, distribute, or extract data (including vehicle information and images) whether manually or by automated means (e.g., bots, crawlers, or scrapers). AAN Japan grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the AAN Japan Services strictly in accordance with this Agreement.
08Fees and Payments
You agree to pay all fees and charges associated with the AAN Japan Services in the currency and payment method designated at the time of order. You are responsible for all transaction charges, including bank fees, taxes, or conversion costs.
09Disclaimer of Warranties and Limitation of Liability
The AAN Japan Services are provided on an “as is” and “as available” basis. AAN Japan makes no warranties of any kind, express or implied. To the full extent permissible by law, AAN Japan will not be liable for any damages of any kind arising from the use of AAN Japan Services, including direct, indirect, incidental, punitive, and consequential damages.
10Termination and Suspension
Your rights will automatically terminate if you fail to comply with any terms. AAN Japan may also suspend service for system maintenance, emergency conditions (war, civil unrest, natural disasters, hacking), or government orders.
11Jurisdiction and Applicable Law
Any dispute or claim relating to your use of any AAN Japan Service will be adjudicated in the courts of Japan and governed by the laws of Japan.
12Governing Language
It is the express wish of the parties that this Agreement be drawn up in English. In the event of any conflict with translations, the English version shall prevail.
