General

Welcome to A.A.N. Japan Co., Ltd. (“AAN Japan”). These Terms and Conditions (“Terms”) apply to all exports of used motor vehicles (“Vehicles”) sold by AAN Japan to customers located outside Japan (“you”). By transferring a deposit for the purchase of Vehicles, you agree to be bound by these Terms.

Our Role

AAN Japan specializes in sourcing, preparing, and exporting used motor vehicles from Japan. We act either as a direct seller from our stock or as an agent facilitating purchase and export of auction vehicles. All Vehicles are sold as is, unless otherwise stated in writing.

Deposit Requirement

To begin doing business with AAN Japan, you must transfer a deposit:

• Bidding up to JPY 1,000,000: deposit JPY 100,000

• Bidding over JPY 1,000,000 and up to JPY 5,000,000: deposit JPY 300,000

• Bidding over JPY 10,000,000: deposit 50% of your requested bidding limit

AAN Japan may require a higher deposit for expensive lots or special equipment. The deposit is required to activate your account and remains on hold for the duration of our business relationship. It will not be applied to each individual purchase; instead, it will be credited toward the final invoice of your last Vehicle purchase. The deposit is refundable upon request, but the customer is responsible for all bank fees. Refunds are processed within 30 business days to the original remitting account. If you cancel a purchase after a Vehicle is secured, the deposit will not be refunded.

Vehicle Sourcing & Condition

Vehicles are sourced from Japanese auto auctions and/or AAN Japan stock. Availability, pricing, and condition depend on the actual auction outcome. All Vehicles are sold strictly as is.

Auction grades, inspection sheets, and reports are for reference only. AAN Japan does not guarantee the accuracy of third-party reports, odometer readings, repair history, or accident records. You are solely responsible for ensuring the Vehicle complies with import requirements (year, emissions, etc.) in the country of destination.

Auction Sheet Translations

AAN Japan provides Manual Translations (by staff) and Automatic AI Translations. If you purchase without requesting a manual translation, you bear full responsibility for AI accuracy. Manual translations must be requested in advance. You are responsible for reviewing all diagram marks and symbols on the auction sheet.

Prices & Payments

All prices and payments are in Japanese Yen (JPY). Other currencies will be converted using the TTB rate of MUFG Bank on the date of receipt. Full payment is required within 3 business days of purchase. Installment plans may be offered, but shipment is released only after final payment. Late or incomplete payments may result in order cancellation or resale of the Vehicle.

Additional Transportation

Extra charges may apply for: remote car parks, lowered/raised suspension, non-self-propelled units, vehicles over 2m height, high roof racks, heavy oil leakage, one-price sales/AUCNET auctions, trucks, and storage for more than 1 month.

Delivery & Incoterms

All deliveries follow Incoterms® 2020 (FOB, CFR, CIF). Risk passes at the point defined by the applicable rule. We are not responsible for delays caused by brokers, carriers, port congestion, customs, inspections, or strikes. You are responsible for import clearance, duties, and taxes.

Ro-Ro Shipment

Ro-Ro Minimum Condition (Must Have):

• Ground clearance 15 cm

• Hood opens normally

• Drivable: Engine starts; transmission engages; moves under its own power

• Steering, tires, and brakes must function normally

• No tow/lift/winch required

• Glazing: Windshield and windows present, intact, and securable

• No inner cargo: Interior, trunk, and roof rack must be empty

Ro-Ro Not Accepted (Refusals):

• Engine does not start or white/black smoke

• Leaks of oil, fuel, coolant, or other fluids

• Defective Hybrid/EV traction batteries

• Missing glass or non-securable windows

• Any loose items or inner cargo

Carrier/terminal may refuse unsafe units. All costs for rebooking, switching to container, or returning to yard are yours.

Container Shipment

Containers are stuffed and secured to industry standards (blocking, bracing, straps). After stuffing and sealing, risk passes per Incoterms; we are not liable for cargo shift where stuffing complied with the plan. If you instruct overstuffing or mix incompatible sizes, you accept all risks of contact damage and fluid leaks.

Video-Open Requirement: You must unseal the container under continuous video showing exterior, seal number, and the entire unstuffing process. Claims without this video or reported after gate-out will not be accepted.

Additional Shipping Costs

All extra costs are for your account, including: Re-stuffing, port storage/demurrage, container detention, missed-cut or rebooking fees, crane/forklift labor, decontamination, waste disposal, and courier/document amendments.

Inspection & Compliance

Certain destinations require mandatory Pre-Export Inspection (PEI). We arrange PEI only on your request and expense. If a vehicle fails PEI, all rectification and re-inspection costs are yours.

Export Documents

Standard documents: Bill of Lading, Commercial Invoice, Packing List, Export Certificate. For USA shipments, ISF data is provided for your broker. Original documents are released only after confirming full payment. AAN Japan is not liable for third-party processing delays.

Lien & Withholding

AAN Japan may retain possession of any Vehicles, parts, or documents until all amounts due (fees, storage, penalties) are paid in full.

Risk & Title

Risk of loss passes per Incoterms. Title transfers only after full payment has been received by AAN Japan.

Cancellations

Cancellations are only permitted within Auction House timeframes (generally 30-120 min). Otherwise, the Vehicle will be re-auctioned, and you are responsible for all losses, penalties, and fees. If a seller refuses to complete a sale, AAN Japan will refund the payment but is not liable for opportunity costs.

Claims

Claims must be submitted through your account. Acceptance is determined solely by the auction rules. Auctions do not accept claims for: Accident/Low Price corners, mileage over 150k km, price under JPY 500,000, modified vehicles, or vehicles older than 20 years. Photos uploaded to your account must be reviewed immediately.

Warranties & Exclusions

Vehicles are sold as is. No warranty applies to: Wear and tear, hidden damage, odometer/repair history, or suitability for your country's import laws.

Limitation of Liability

Maximum liability shall never exceed the purchase price of the Vehicle. AAN Japan is not liable for indirect, incidental, or consequential losses, loss of profit, or errors in AI translations and reports.

Communication

Disputes must be submitted through the designated Claims section before posting negative feedback. Posting negative feedback without prior claim submission may result in withdrawal of further assistance.

Responsibilities

You must comply with export/import, sanctions, and safety laws. These Terms are subject to the AAN Japan Terms of Use and Compliance Policies.

Jurisdiction

Any dispute will be adjudicated in the courts of Japan. Laws of Japan govern these Terms and any disputes that might arise.

Language

These Terms are drawn up in English. In the event of discrepancy with translations, the English version shall prevail.

Updates

We may update these Terms by posting a revised version. Continued purchasing constitutes acceptance of the updated Terms.

Public Offer

This document is a Public Offer and is binding upon order placement. If required, AAN Japan may provide a signed copy with the same legal effect.
